Inquiring About Tickets & Infractions

Benton County District Court does not hold in-person mitigation hearings.

You have 30 days from the date the ticket was issued to respond to the infraction. 

You have 4 options to choose from to respond to a ticket:

1. PAY YOUR TICKET.  You want to pay the listed penalty.
2. MITIGATE.   You want to ask for a reduction in the fine amount.
3. DEFER.   You want to keep the infraction off your driving record.
4. CONTEST.  You want to challenge the infraction and have it found not committed.

***If you received a No-Insurance Infraction AND you had valid insurance at the time you were given the infraction:***

1. Complete: Mitigation by Mail Form (English) or Mitigate By Mail Form (Español)
2. Attach a copy of your proof of insurance on the date of the infraction.
3. Return form & proof of insurance to Benton County District Court:

With PROOF OF INSURANCE at the time of the traffic stop, your infraction will be dismissed with a $25 administration fee.

DEFER

Deferrals are held by mail or email ONLY.

The FULL COST of the infraction will be imposed.

1. Complete:  Mitigation By Mail Form (English) or Mitigate By Mail Form (Español)
   Mark the box to DEFER your infraction.
   ***NOTE: You may not defer your infraction if you have a CDL.***

CONTEST

Contested hearings are being held in court AND by mail or email.

If you want to come to court in person:

1. Complete the Personal Information Area on your infraction (Name, Address, Telephone #).
2. Mark the box for Contested Hearing.
3. You will receive a Notice for Case Setting by mail with your hearing date.
