HOW TO REQUEST A HEARING ON YOUR PRE-ASSIGNED CASE:
A litigant seeking a Special Set Hearing on a case pre-assigned to a Benton/Franklin Counties Superior Court Judicial Officer or Out-of-County Superior Court Judicial Officer must:
- Fill out the request form -
- Email the request form to: specialsets@co.benton.wa.us (All attorneys and/or parties involved must be included on the email).
- After your email and request form is received:
- A responsive email will be sent to acknowledge receipt of your request/email;
- You will receive a list of dates (3) available for the Judicial Officer.
- Stipulation to available dates:
- You must jointly reply to the email outlining the dates within two (2) business days.
- No Stipulation to available dates:
- Court Administration will determine the date from the selection list (email will be sent with the date).
- The requesting party must:
- File a note for motion reflecting the date approved/selected by Court Administration.
- After your email and request form is received:
NOTE:
- If you fail to file the notice of hearing your hearing will not be scheduled.
- The Court receives a high volume of Special Set requests, which are answered in the order they are received.
- The Special Set process can take up to a week, please be patient.
- If you have not received a response back within a week, please re-submit using your previous email.
- If you fail to comply with the above requirements, the Special Set will not be scheduled.
- Once a special set is approved, it is expected to proceed. Prior approval from specialsets@co.benton.wa.us is required before striking or continuing a special set.
