1. Counsel/Parties: Shall contact Court Administration by way of Special Set Request/All Other Case Types and request a special set for an evidentiary hearing: https://www.co.benton.wa.us/pview.aspx?id=55294&catID=0
  2. Follow the special set instructions outlined on the Court’s webpage.
  3. Court Administration: Shall schedule the special set hearing and advise counsel/parties of the date/time of the special set hearing via e-mail.
  4. Counsel/Parties: When they receive the special set hearing date/time, counsel for the petitioner/petitioner shall prepare and file a Notice of Hearing for a Special Set detailing the date and time of the hearing and shall provide a copy of the notice to the Court Administration in addition to all parties using the Special Set process email: specialsets@co.benton.wa.us
  5. Counsel/Parties: Each party shall file a witness list (detailing the name and telephone number of each witness and a short summary of the testimony of each witness) AND an exhibit list two weeks before the special set hearing date.
  6. Counsel/Parties: Each party shall serve their witness list, exhibit list and a copy of their exhibits on the opposing side two weeks before the special set hearing date.
