CIVIL/DOMESTIC/PATERNITY/GUARDIANSHIPS
- Amend Case Schedule. Court may modify/amend the Case Schedule, for good cause, by motion of the party, stipulation of all parties, or by the Court's own motion.
- The Court shall freely grant a motion to amend the case schedule when justice so requires, and only after receiving and attaching a Certificate of Judicial Assistant's Pre-Approved Dates (which will expire 30 days after the Judicial Assistant's signature).
- Certificate of Judicial Assistant's Pre-Approved Dates
- Trial Continuance. Parties may stipulate or motion the court for a continuance of trial (which does not require an amendment of the case schedule order) only after receiving and attaching a Certificate of Judicial Assistant's Pre-Approved Dates (which will expire 30 days after the Judicial Assistant's signature).
- Contact Other Parties. Prior to contacting Superior Court Administration (Judicial Assistant) to determine available dates to continue settlement conference, pre-trial conference, trial, or to amend the case schedule order, the party seeking to modify the order shall contact all other parties to determine if there is an agreement. Whether the other parties are in agreement or not, the party seeking the modification/amendment parties must receive Certificate of Judicial Assistant's Pre-Approved Dates prior to amending the case schedule order.
- Motions to Modify/Continue without Agreement. Once the available dates are identified by the Judicial Assistant, the party seeking to modify dates may move for relief by filing and serving a motion to modify along with a declaration and attach a Certificate of Judicial Assistant's Pre-Approved Dates and note the motion on the appropriate docket. - Motions to Modify/Continue with Agreement. Once the available dates are identified by the Judicial Assistant, the party seeking to modify dates may move for relief by filing and serving a motion to modify along with a declaration and attach a Certificate of Judicial Assistant's Pre-Approved Dates and note the motion on the appropriate docket or present the Motion at ex parte. - Available Dates. The dates provided to the parties by way of the certificate will expire thirty (30) days after the Judicial Assistant's signature or as otherwise noted on the form.
- Signed/Granted Orders to Amend/Continue. All orders to continue trial or amend the case schedule order shall be provided to the Judicial Assistant within three (3) court days of entry of the order.
